Michigan regulators approve 20-year DTE-Google contracts with cost protections for other customers

The Michigan Public Service Commission voted unanimously on October 1 to conditionally approve two DTE Electric agreements serving Google's planned 1 gigawatt Van Buren Township data center. The order imposes a 20 year contract term, an 80 percent minimum billing demand and a 15 year termination payment, and requires Google to pay for up to 1,600 MW of new renewable generation and 480 MW of battery storage; Attorney General Dana Nessel had argued for a 90 percent minimum billing demand.

Check it: Check whether the 80 percent minimum billing demand and 15 year termination payment actually hold if Google scales down the site or exits early, since those terms govern how much risk sits with other DTE customers.

Saginaw City Council adopts data center ordinance with 500-foot setbacks and 55-decibel noise cap

Saginaw's council voted 8-0 to limit data centers to industrial districts as a special land use, require reports on water and energy use and wastewater discharge, and mandate at least two neighborhood meetings before approval. The rules take effect October 9, ahead of the city's existing development moratorium ending December 31.

Brighton Township, Michigan adopts moratorium on new data center applications

Brighton Township joined other Livingston County communities in pausing new data center applications while the planning commission drafts rules, calling the vote a housekeeping step because the current ordinance does not mention data centers. The Michigan Townships Association has recommended similar reviews statewide.

Michigan lawmakers look to rein in data centers

Two Michigan Republican members of Congress introduced federal bills that would bar Washington from overriding state and local control of data center siting and prohibit non-disclosure agreements about them, while a Michigan Democrat filed a bill to strip data center access to certain federal opportunity-zone tax breaks. In Lansing, state moratorium and community-benefit bills remain stalled and Governor Whitmer has said she would veto any statewide moratorium.
